Legals Only Terms and Conditions

Terms & Conditions

It's is an absolute privilege to be part of such a special occasion, and I look forward to creating a ceremony that is relaxed, meaningful and uniquely yours.

These Terms & Conditions are designed to protect both you and me while ensuring the planning process is smooth, transparent and enjoyable.

Booking & Payments

A non-refundable booking fee of $300 is required to secure your wedding date.

Your booking fee reserves your ceremony date in my calendar and covers the administration and preparation that begins immediately after your booking is confirmed.

The remaining balance is due no later than four (4) weeks before your wedding day.

If making smaller payments along the way would make things easier, I'm more than happy to arrange a payment plan. Just let me know.

Cancellation & Postponement

Should you cancel your ceremony more than four (4) weeks before your wedding date, all monies paid, excluding the non-refundable booking fee, will be refunded.

If your ceremony is cancelled within four (4) weeks of the scheduled wedding date, no monies will be refunded, as it is unlikely I will be able to secure another booking at such short notice.

If your wedding is postponed, I will do everything possible to accommodate your new date. If I am unavailable, we will discuss the options available to you.

Travel

Travel is included for ceremonies within a 250 km return journey from my home.

If additional travel is required, travel expenses will apply in accordance with my Statement of Fees.

My Responsibilities

As your Authorised Marriage Celebrant, I will:

• Perform your marriage ceremony at the agreed date, time and location.

• Arrive at least 40 minutes before your ceremony to ensure everything is prepared and running smoothly.

• Guide you through every legal requirement associated with getting married in Australia.

• Prepare your personalised ceremony.

• Prepare, witness and lodge all required legal documentation.

• Register your marriage with Births, Deaths and Marriages within the required legislative timeframe.

• Apply for your Official Marriage Certificate on your behalf if you have chosen this service.

• Provide your commemorative Marriage Certificate on your wedding day.

• Work closely with your photographer and videographer to ensure everyone is positioned for the best possible photographs while allowing your guests an uninterrupted view of your ceremony.

If unforeseen circumstances prevent me from conducting your ceremony, I will arrange for a trusted Authorised Marriage Celebrant from my professional network to perform your ceremony in my place.

Should this occur, I will ensure all documentation is transferred promptly and correctly so your wedding proceeds as planned.

If I have already witnessed and lodged your Notice of Intended Marriage, an administration fee of $200 will be retained for work already completed.

Ceremony Delays

If your ceremony cannot commence within one hour of the agreed starting time due to circumstances outside my control, I reserve the right to leave in order to honour other professional commitments.

If I am available to remain or return later that day, an additional fee will apply in accordance with my Statement of Fees. Should the ceremony need to be rescheduled to another date, a revised fee will be negotiated.

Your Responsibilities

To ensure your ceremony proceeds smoothly, you agree to:

• Lodge your Notice of Intended Marriage (NOIM) with me at least one month before your wedding date.

• Provide all original identification and supporting documentation required under Australian Marriage Law, including birth certificates, passports, divorce orders, death certificates, change of name certificates or translations where applicable.

• Ensure all required documents have been sighted by me before your wedding day.

• Notify me immediately if your ceremony time, date or venue changes.

• Provide your final ceremony selections and wording no later than two weeks before your ceremony.

• Attend appointments as arranged and let me know as soon as possible if you need to reschedule.

• Ensure you and your two witnesses arrive in plenty of time for the ceremony to begin as scheduled.

Notice of Intended Marriage

The Notice of Intended Marriage (NOIM) must be signed and witnessed at least one month before your wedding date. This is a legal requirement under Australian Marriage Law.

If you are signing your NOIM overseas, it must be witnessed by an authorised person as prescribed under the Marriage Act.

Shortening the Notice Period

If your Notice of Intended Marriage cannot be lodged one month before your wedding, you must apply to Births, Deaths and Marriages for a Shortening of Time.

Approval is granted only under specific circumstances permitted by Australian law, and I cannot solemnise your marriage until approval has been granted.

Identification

If original identification documents have not been produced before the ceremony, I am legally unable to solemnise your marriage. This is a legal requirement and cannot be waived.

Interpreter

If either party or either witness cannot understand spoken English sufficiently to understand the legal wording of the ceremony, you must arrange an accredited interpreter.

The interpreter must complete all declarations required under Australian Marriage Law.

Capacity to Marry

Australian law requires both parties to freely understand and consent to the marriage.

If either party appears to be significantly affected by alcohol or drugs at the time of the ceremony and is unable to legally provide informed consent, I cannot perform the legal marriage.

In this circumstance, I may conduct a symbolic commitment ceremony only.

Your legal marriage will then be completed at a later date through a separate Legals Only Ceremony with two witnesses present.

An additional fee of $600 will apply to cover the preparation of new legal documentation and the performance of the legal ceremony.

If either witness is intoxicated and unable to fulfil their legal responsibilities, alternative witnesses over the age of 18 must be appointed before the ceremony can proceed.

Copyright

All ceremony scripts remain the intellectual property and copyright of Lynda Leith Celebrant Services.

Your ceremony has been personally written for you and may not be copied, reproduced, published or distributed without my written permission.

Photography & Social Media

I love celebrating the beautiful ceremonies I have the privilege of officiating.

By accepting these Terms & Conditions, you grant permission for photographs or video featuring your ceremony to be used on my website, social media and promotional material.

Professional photographers will always be acknowledged. If you would prefer your wedding remain private, simply let me know before your ceremony. I will always respect your wishes.

My Promise to You

My commitment is to make your wedding ceremony relaxed, enjoyable and unforgettable.

I'll guide you through every legal requirement, communicate with you throughout the planning process, and support you every step of the way.

I can't wait to get you happily married!
